Story Terms
These Story Terms (hereinafter referred to as "Terms") stipulate the conditions for providing the story service by KabuK Style Inc. (hereinafter referred to as "we," "us," or "our") and the rights and obligations related to the service between us and our members. When using the story service, please read these Terms and agree to them. Unless otherwise defined in these Terms, the terms used herein must be construed in accordance with the HafH General Terms and Privacy Policy and guidelines.
Article 1. Stories
- The story service is a service (hereinafter referred to as the "Service") aimed at collecting information and exchanging opinions regarding the use of accommodation facilities or airline subscription services by users of HafH operated by us. Providers that manage and operate accommodation facilities or airline tickets are collectively referred to as "Providers."
- In these Terms, "story" refers to all information posted by members on HafH using the Service regarding the use of accommodation facilities or airline subscription services and other matters (including image data taken by members).
- Other members and Providers may reply to, or answer stories posted by members on HafH.
- The specific details of the Service, including the content and any related services, may be determined and changed at our discretion.
Article 2. Application
- These Terms set forth the conditions applicable to the use of the Service.
- In relation to the Service, we will establish rules regarding the specific operation of the Service including "Travel Story Guidelines," and post them on our web app or website. Members using the Service must confirm these rules and comply with the provisions applicable to the members. Additionally, we may change or modify these rules at our discretion without individual notification.
- In the event of any inconsistency between the content of these Terms and the rules or other explanations outside these Terms regarding the Service, these Terms prevail.
- Matters not stipulated in these Terms are governed by the relevant General Terms, flight terms, privacy policy and other terms from time to time established by us.
Article 3. Story Posting
- Members can post stories in accordance with the rules specified in Article 2, Section 2 hereof.
We will post the following information on HafH along with the submitted story:
(1) Information related to the use of HafH, including the nickname and profile image registered by the member (hereinafter referred to as the "Poster"), the usage date of the accommodation facility, and information regarding the airline ticket. (2) Replies and answers to the story from other members and Providers as stipulated in Article 1, Section 3.
We may determine the period for which stories are posted at our discretion.
Article 4. Posting Restrictions
When using the Service, members must comply with our terms including the General Terms, and must not post stories containing the following matters, expressions (including, but not limited to, image data) or content:
(1) Infringements
- Content that infringes third-party rights (including, but not limited to, Providers and us) such as copyright, trademark rights, portrait rights, privacy rights, and honor rights.
(2) Commercial activities and business interference
- Content for commercial purposes, commercial content, or content unrelated to HafH (including the Service) and related products.
- Content that may harm the reputation of us, Providers or third parties.
(3) Deviation from the purpose of the Service
- Content that has no relation to the services provided by the Providers, or content that has no relation to the purchased airline ticket.
(4) False content
- False content or content clearly contrary to fact (excluding minor expression errors).
(5) Nuisance behavior and others
- Content that violates laws or public order and morality.
- Content that violates the terms stipulated by Providers.
- Content that leads to or incites criminal acts.
- Content related to election campaigns, political activities, or religion.
- Inappropriate expressions, obscene, vulgar, grotesque expressions, or expressions/images that cause discomfort to others.
- Content that intimidates, threatens, slanders, or ridicules others.
- Content containing discriminatory expressions.
- Content with external URLs.
- Images with people (including the members themselves).
- Other content that we deem inappropriate for posting by us.
If we determine that a story contains content stipulated in the preceding section, we may take measures such as non-posting or deletion of the story without the consent of the Poster.
Article 5. Responsibility of Posters
- If a Poster determines that his/her post may infringe the rights of a third party, he/she is obligated to notify us.
- If we reasonably determine that a member's post infringes third-party rights, we may request the member to delete or modify the post through notification, and the member must promptly comply. However, we are not obligated to provide such notification.
- If a Poster's post violates these Terms, infringes third-party rights, or causes claims or demands from third parties, the Poster must resolve the matter at their responsibility and expense without causing any inconvenience to us.
- If a Poster's violation of these Terms causes damage to Providers, us, or third parties, the Poster must compensate for all damages (including attorney's fees).
- If a Poster violates these Terms, we may suspend the use of the Service by the Poster and additionally, based on the General Terms, we may delete the member registration of the Poster.
Article 6. Use of Stories
- We may provide stories and Poster’s information to the Providers featured in the stories and Posters agree to this provision.
- If the information of the Providers featured in the stories is also posted on services provided by our group companies ("Our Group" stipulated in the General Terms), we will provide the stories (including the information stipulated in Article 3, Paragraph 2) to the group companies providing the services. Posters agree that the stories will also be posted on the services provided by the group companies.
Article 7. Copyright
- Posters who use the Service grant us a non-exclusive right to use the stories (including reproduction, screening, public transmission, exhibition, distribution, transfer, lending, translation, adaptation, and publication) domestically and internationally without charge and for an unlimited period (including the right to sublicense and transfer the license).
- Posters agree not to exercise moral rights against us or third parties who have been granted or transferred a license to use the stories from us.
Article 8. Handling of Personal Information
The handling of members' personal information related to the Service will comply with our "Privacy Policy."
Article 9. Disclaimer
- The content of stories is posted under the responsibility of the Posters, and we do not guarantee the truthfulness, legality, safety, appropriateness, correctness, usefulness, or completeness of the content. Members must use it at their own responsibility.
- We do not guarantee the absence of inaccurate, unpleasant, or indecent content in the stories.
- We do not guarantee that the system of the Service will be free from bugs, errors, or defects, that the information obtained from the Service will be accurate, or that the information available through the Service will meet members' expectations.
- We may suspend or interrupt the operation of all or part of the Service without prior notice. In this case, we are not liable for any damages incurred by members due to the suspension or interruption of the Service.
- We may change or update the specifications of the Service without prior approval from members.
- Even if any provision or part thereof of these Terms is determined to be invalid or unenforceable, the remaining provisions of these Terms and the remaining parts of the provisions that were determined to be invalid or unenforceable continue to be in full force and effect.
